The Smithville School District has policies prohibiting illegal discrimination and harassment. Sexual harassment of students is not tolerated and there is a process to provide resolution of discrimination complaints. PROHIBITION AGAINST DISCRIMINATION, HARASSMENT AND RETALIATION

(Notice of Nondiscrimination)

The Smithville R-II School District Board of Education is committed to maintaining a workplace and educational environment that is free from discrimination and harassment in admission or access to, or treatment or employment in, its programs, services, activities and facilities.  In accordance with law, the district strictly prohibits discrimination and harassment against employees, students or others on the basis of race, color, religion, sex, national origin, ancestry, disability, age, genetic information or any other characteristic protected by law in its programs, activities or in employment.  The Board also prohibits retaliatory actions against those who report or participate in the investigation of prohibited discrimination or harassment.  The Smithville R-II School District is an equal opportunity employer.


The district also provides equal access to the Boy Scouts of America, the Girl Scouts of the United States of America and other designated youth groups in accordance with federal law.


The district will identify, evaluate and provide a free, appropriate education to all students with disabilities in accordance with law.  Anyone who knows or believes that a student may have a disability-regardless of whether the student is currently enrolled in the Smithville R-II School District - is encouraged to contact the district's compliance officer listed below.

Anyone who, because of a disability, requires an auxiliary aid or service for effective communication or requires a modification of policies or procedures to participate in a program, service or activity should contact the compliance officer listed below as soon as possible, but no later than 48 hours before the scheduled event.

Title IX Prohibits Sexual Harassment and
Sexual Violence in Public Schools

Title IX of the Education Amendments of 1972 ("Title IX"), 20 U.S.C. §1681 et seq., is a Federal civil rights law that prohibits discrimination on the basis of sex in education programs and activities. All public and private elementary and secondary schools, school districts, colleges, and universities (hereinafter "schools") receiving any Federal funds must comply with Title IX. Under Title IX, discrimination on the basis of sex can include sexual harassment or sexual violence, such as rape, sexual assault, sexual battery, and sexual coercion.

Federal law requires that schools have and distribute a policy that prohibits discrimination and harassment based on sex and acts of sexual violence. In compliance with Title IX, it is the policy of the Smithville R-II School District to maintain a learning and work environment free from discrimination and harassment based on sex.

The Smithville R-II School Board of Education adopted Policy ACA that defines sexual harassment under Title IX, and outlines the policies and procedures that the District follows in identifying, investigating, and responding to allegations of sexual harassment under Title IX. the requirements of Title IX.
